MindFix Programs

Terms & Conditions

By participating in any MindFix program,
you hereby acknowledge and agree to the following:

1. Booking Sessions

Respecting the booking and attending of one’s sessions is paramount to one’s progress.

MindFix programs are cumulative and are meant to be experienced on a continual basis, each month, from start to finish.

You are responsible for making the most of your investment and ensuring you are booked for your sessions each month through your program, and for showing up on time to your scheduled calls.

Please remember:

  • Any scheduled sessions you do not attend are counted towards your total.
  • All sessions in a package must be completed by the package due date.
  • If you wish to reschedule a booked session, you must do so at least 48 hours prior. Scheduled sessions cancelled within 48 hours of a a session’s start time are counted toward your total.
  • If a client has not arrived to a session within 15 minutes of the session’s scheduled start time, the session will be considered a “no-show” and the session will be counted as being used.

Booking initial sessions / Starting your MindFix Program:

  • Clients will book in their first MindFix session within 14 days of receiving your Onboarding materials and starting their onboarding processes. If no sessions are booked within 14 days, the Program will go into Pause.

All this being said, we know life happens and we will work alongside you with flexibility whenever possible to ensure your program experience is smooth and enjoyable.

Emergencies: If there is an emergency or highly unusual circumstance during your Program and you’re not able to make a session, you may skip one booked session without penalty, so long as you let your coach and program manager know prior to missing the session.

Program Maturity Date: MindFix programs have expiration dates. Any sessions not used by a Program’s expiration date are forfeited.  If you need to step away from your Program prior to the expiration date for a period of time, you may choose to use a Pause Clause to protect your investment.  See “Pause Clause” below for more information.

 

2. Pause Clause

Sometimes, life gets in the way.  We start a Program, make a commitment, and things come up that don’t allow us to be as present as we’d like.

For this reason, we have a Pause Clause to protect your investment.

If something does come up during your Program and you need to Pause, you have the option to activate a Pause Clause once, for up to 3 months.

Upon Pause Clause Activation (requires written request from Client and confirmation by MindFix):
– Booked sessions with your coaches will be canceled at no extra charge to you.
– No full or partial refund is applicable.

Upon your return to your Program:
– A $1500 restart fee is required for program resumption.
– Your program’s expiration date will be adjusted at MindFix’s discretion upon fee payment.

Payment Schedule:
– Your program’s original payment terms remain unchanged during the Pause. No additional penalties or late fees will be applied.
– Continuation of payments toward your program total continue uninterrupted during your Pause period.

 

3. The MindFix Guarantee

All MindFix Programs other than MindFix Select and Scholarships come with a guarantee.

If you’re not convinced MindFix is a great fit for you within 21 days of your Onboarding session, you may request a refund and you’ll have your Program payment back in your bank account within 1 week.  We’ll refund your entire payment minus a $1,600 fee.

There are 3 requirements to qualify for this refund:

  • (1) The request is received within 21 days of your Onboarding call.
  • (2) You upheld your end of the relationship.  This means:
    • You booked in your sessions within 1 weeks of completing your onboarding
    • You completed your Onboarding pre-work before your first session, allowing you to arrive prepared and ready.
    • You showed up for your sessions, and participated for the full duration
  • (3) You did not have, nor introduce, distressing elements during your program that hindered your ability to experience change, such as serious health issues, substance abuse, poor nutrition, ongoing lack of sleep, nervous system dysregulation, or clinically diagnosed mental issues or physical diseases.

MindFix Select, MindCamps, and Scholarship programs are not guaranteed. No refunds of any form will be provided.

4. Expiration Extension Option

Expiration Extension 

The Expiration Extension is designed to help you continue your journey with us while ensuring ample time to take full advantage of your program.  We understand that sometimes, you may need a little extra time to complete your program. For this reason, we offer an Expiration Extension option to allow for continued progress. If you require additional time at the end of your program, you may extend your program for up to 3 additional months. Here’s how it works:

Expiration Extension Activation (requires written request from you and confirmation by MindFix):

  • A non-refundable fee of $1,500 is required to activate your 3-month extension.
  • Your program’s expiration date will be extended by 3 months from the original expiration date.
Additional Details:
  • No full or partial refunds are applicable to the Expiration Extension fee.
  • All sessions not used within the extended 3-month period will be forfeited.

 

5. Our Strongest Program Recommendation: Track Your Shifts

The work you engage in at MindFix often makes change feel easy–sometimes even effortless.  However, we humans aren’t wired to easily appreciate or notice when difficult experiences DON’T happen. Instead, we typically focus on what DOES show up in our environment.

Therefore, it can actually take a bit of focus for many clients to notice the changes happening in their lives—even when a change occurs that is the exact result they’ve long been desiring!

Many of our clients have had major life changes occur—ones they’ve been hoping for—yet barely recognize them when they occur unless they pause and actively look for them.

To that end, we assign one single piece of weekly progress work during your Program, and it’s the same each week.  This work is tracking your Shifts.

This work shouldn’t take more than 15 minutes each week, and we can’t emphasize enough that you take this small bit of reflection very seriously.  The clients who do see the greatest results and report the highest satisfaction with their Programs.

 

6. Payments

You are purchasing a package, not a monthly service. All monthly payments for the package are due within 7 days of invoicing and must be paid in full prior to attending of the month’s sessions.

Sessions are not transferrable without written consent.

All fees for this Agreement are immediately earned by MindFix.

 

7. Program Cancellation + Refunds

Upon enrolling in the program, you agree to a binding commitment for the full duration of the program. The total program fee is payable as an upfront amount followed by scheduled payments. This is not a month-to-month agreement. The commitment is for the entire program length.

Cancellation: You may cancel this agreement within 21 days of your Onboarding session. You will receive an email confirming our receipt of your message and a refund of all monies within 14 days, minus a $1800 administration + Program Initiation fee.

Early Termination: 

  • If you decide to discontinue the program before its scheduled completion, you are responsible for the full payment of the remaining program fees. 
  • Collection of Dues: In the event of early termination, any outstanding balance becomes due within 14 days. We reserve the right to employ collection methods, including but not limited to, third-party collections agencies or legal action, to recover any unpaid dues.
  • There are no other cancellations or refunds, and you are expected to pay for the full amount of the program, regardless of use or participation, no exceptions.
  • You further acknowledge that in accepting the terms of this Agreement and affirmatively seeking the benefits of a MindFix Program, you take full responsibility for your own success. Thus, you agree you will not request a refund of fees paid nor a cancellation of future agreed-to payments as per your transaction receipt.

 

8. Additional Fees

Request to Change Sessions
If your program is six (6) months or shorter:

  • Your session count and session types are established when you purchase your program. Changes to programs are rare. Requests for changes to sessions counts or types or assigned coaches must be pre-approved, in writing by a MindFix Program Manager.
  • Example 1) You request to swap two sessions with coach A for two sessions with coach B. Session cost is the same for both coaches.
  • Example 2) You request to swap 2 sessions with Coach C for one session with coach D. Session cost is higher for Coach D.
  • Each time a program change is approved, you will receive an invoice with a session swap fee of $375.00 for that occurrence. Once paid, the new, swapped sessions may be booked.
  • The Pause Clause does not affect the original program length.

 

9. Notices

1. MindFix does not diagnose, prescribe, treat, or cure any disease or mental condition. The FDA has not evaluated this information and we make no curative claims.

2. All MindFix techniques and exercises are healing and personal development techniques used for stress reduction, relaxation, balancing mind-body systems, and personal insight. They are not a substitute for medical care or therapy. You represent that you do not have any mental health conditions that coaching could make worse.  You understand our coaches are not medically trained to monitor your mental health during sessions. You agree to contact your own doctor for any questions regarding your ability to be coached safely. This program is for your recreational use only and nothing stated, given, or written should be taken as medical advice.

3. Past MindFix clients who have shared their results, or are featured in case studies, are not compensated in any way.

4. MindFix is not therapy, nor counseling. It is not represented as fact, nor is intended to replace professional medical treatments offered by any doctor, psychotherapist, psychoanalyst, psychiatrist, psychologist, counselor or social worker. The information presented is based upon the research, experience, and opinion of the practitioners. You should not believe a word we say, because what we say is based upon our experience. You will have your own experience, and MindFix will become part of your experience. Your perspective, or attachments to the past or future may shift in ways that serve you. You may notice new thoughts and behaviors. You will be the sole judge of what to keep and what to let go of during this process. No one is advised to avoid or discontinue medical or psychological care, because MindFix is not a substitute for the advice and treatment of licensed health care professionals. Clients who fail to consult with appropriate health care professionals assume any risk. The information we provide in MindFix is for informational and educational purposes only. It is not meant to diagnose, prescribe, treat, or cure any disease or mental or medical condition. The FDA has not evaluated this information and we make no curative claims. Our service is not therapy and does not substitute for therapy. You are responsible for determining your own medical and psychological needs. If you are experiencing psychological distress, you must consult with a licensed physician, therapist, psychologist, psychiatrist and/or other professional. We do not offer psychological services, psychological advice, or medical advice. By participating in a MindFix program, you agree that what we teach is not represented as fact, nor is intended to replace professional medical treatments offered by any doctor, psychotherapist, psychoanalyst, psychiatrist, psychologist, counselor or social worker. This information and the opinions provided here are believed to be accurate and sound based on the our knowledge, experience, and research. No one is advised to discontinue or avoid medical or psychological consultations. Clients who fail to consult with appropriate health authorities assume any risk.

5. Our relationship, as well as all information that you share with us during the relationship, will be kept confidential. However, please be aware that our relationship is not considered a legally confidential relationship (like the medical and legal professions) and thus communications are not subject to the protection of any legally recognized privilege. By working with us, you consent to allow everyone on our team to speak to one another about your sessions and what you share during those sessions so that we can provide you with a more comprehensive, coordinated experience.

6. The practitioners are not liable or responsible for any actions you take or resulting circumstances you experience as a result of what you learn in this program and by engaging with this material you a) assume full legal responsibility and b) waive any rights to hold Erin Pheil and/or the MindFix Group and its employees and contractors liable in any way, shape or form. Participation in the MindFix work is voluntary. You agree that decisions or actions you make or take are made of your own free will, and are the liability and responsibility of you alone.

7. Consent for marketing purposes. By participating in a MindFix program, you consent to allowing us to use your results, communications, or experiences in future marketing, promotional materials or conversations with other clients or prospects. We will NEVER, however, disclose any information that identifies you without your written consent. Nor will we ever disclose your name as a reference without your consent.

8. All MindFix materials shared with you are copyrighted intellectual property. All usage rights are owned and controlled by TimeForCake Creative Media, Inc. unless otherwise stated. Provided materials are available for non-commercial, personal use only. You may not copy, reproduce, republish, upload, post, transmit or distribute online MindFix materials without express written permission first. You must make no modifications to the materials. You may not use the materials to suggest an association between yourself and any of our programs, or brand. Nor may you alter, add, delete, or misrepresent any content. You must retain all copyright, trademark and proprietary notices.

9. Unpaid invoices: There is a $250 late fee for any invoices not paid by their due date.  An additional $250 late fee is incurred for invoices not paid within 14 days of their due date.  After 30 days, unpaid invoices will be sent to Collections. If an invoice is not paid within 14 days, a Pause Clause will also go into effect, requiring an additional $1500 fee to restart your program.

All invoices are due unless MindFix and Client have a written agreement that a Pause Clause is in effect.

10. Your Results: Your results will be directly impacted by your willingness and ability to show up and participate fully and honestly in your sessions.

 

9. Acknowledgement of Terms

By enrolling in the program, you acknowledge and agree to these terms. We encourage you to consider your commitment seriously, as this agreement is legally binding and enforceable.

We aim for transparency and mutual understanding in our agreements. Please ensure you fully understand these terms before enrolling. Our team is available to answer any questions or clarify any concerns you may have.
